General Sales Terms and Conditions

The General Conditions of Sale detailed below apply to all orders placed on the Alsagarden site and to all the products and services offered, unless there is a different prior written agreement. These general conditions of sale are systematically offered to the knowledge of each buyer to enable him to place an order. Consequently, placing an order implies full and unreserved acceptance by the buyer of these general conditions of sale.

Article 1 – Products and Prices : The products sold on the Alsagarden site are exclusively intended for non-professional use, for an amateur market. The prices of our products are denominated in euros and include VAT (all taxes included), excluding participation in shipping costs. The products remain the property of Alsagarden until full payment of the price. Alsagarden may be required to modify its prices at any time but undertakes that the products will be invoiced on the basis of the prices in force at the time of registration of the order subject to availability on this date and its effective payment.

Article 2 – Order : On the Alsagarden site, the information provided by the buyer when taking the order commits him. In the event of an error or incomplete mention in the wording of the recipient’s contact details, Alsagarden cannot be held responsible for non-receipt of the order or in the case of pending delivery of the package, Alsagarden cannot be held responsible. the final quality of the delivery. Article 4 – Availability : Our product offers are offered within the limits of available stocks, if an item is missing, we reserve the right to replace a product with an equivalent item or otherwise refund it. Alsagarden cannot be held responsible for the non-performance of the contract concluded in the event of out of stock or unavailability of the product, force majeure, disruption or strike of means of transport and/or communication, flood, fire.

Article 5 – Delivery : Deliveries are made within the limits of available stocks and made in mainland France and throughout the European Union. For shipments outside mainland France or requiring specific transport, do not hesitate to contact our customer service first. When your order includes both plants and other items, your order may be sent to you in several packages and possibly on separate dates. Shipping costs are calculated according to the weight and destination of the shipment, in accordance with the postal rates in force, and billed identically to the customer. Delivery costs are offered in metropolitan France from a purchase greater than 49 euros. In all cases, the costs of provision will be clearly mentioned with the price of the product in your basket before validation. The delivery times are given as an indication and without guarantee. In the event of the absence of the recipient or pending dispatch for various causes beyond our control (incorrect or incomplete delivery address indicated when taking the order (forgotten apartment number, wrong postal code, recipient’s name absent from the mailbox….etc), Alsagarden cannot be held responsible for the final quality of the delivery.And in the event that the shipment is returned to us, a second delivery will be made at the customer’s expense. and in the event of cancellation of the order by the customer, the refund will be made, actual delivery costs deducted.The sale is concluded under the “departure” conditions, Alsagarden cannot be held responsible for non-receipt of the order, or for delays, except in cases of manifest error on our part.

Article 6 – Payment : The payment of your purchases is made: by credit card, by bank transfer, by paypal or by check. The choice of payment method is made during the ordering process.

Article 7 – Securing : When paying by credit card, the customer indicates at the end of the order his card number, his cryptogram and the date of validity. Various accesses to authorization servers are then carried out in order to verify the data to prevent abuse and fraud. For this, the server is in encrypted mode and all the information conveyed is coded (SSL protocol). Nothing travels unencrypted on the web. You will be notified immediately of the status of the payment (payment granted or refused) by displaying a screen with a hypertext link to return to the Alsagarden website. Alsagarden’s computer system is notified at the same time as you of the payment status to enable it to complete your current order. If your payment is accepted by the bank, you will receive a payment confirmation email.

Article 8 – Services and Guarantees : For all orders, suitable packaging for the product will be chosen and prepared with great care. Our seeds and plants are sent in full health with an optimal germination rate. The success of planting seeds or plants does not depend solely on their quality, so it is not possible for us to provide any guarantee at this level. Upon receipt of your order, if you consider that a plant has been delivered to you in poor or sick condition, Alsagarden undertakes to study your request on the basis of photos that you will have sent by email or post within 24 hours maximum from receipt of the package, and reimbursement or replacement of the plant in the event that its condition does not allow its recovery. The guarantee of the right of return applies to all products that are not likely to deteriorate rapidly. To exercise this guarantee and in accordance with Articles L.121-20 of the Consumer Code, you have a withdrawal period of 14 days from the delivery of your order to return your item(s) to us within their original packaging (at your expense). No dispute concerning the authenticity of the varieties can be made after the expiry of the first vegetative period. The guarantee of authenticity of the varieties is limited to the choice of the seller, either to the replacement of the seeds or plants concerned, or to their reimbursement respectively according to the price invoiced at the time of shipment. The buyer cannot claim to be compensated in other respects and in particular for loss of profit or for any costs relating to this varietal error.

Article 9 – Intellectual property : This entire site is subject to French and international legislation on copyright and intellectual property. All reproduction rights are reserved for the texts, graphics, photos, audio and audio-video of this site. The reproduction, retransmission and publication of all or part of this site on an electronic medium or any other medium whatsoever is strictly prohibited without our prior written consent.

Article 10 – Responsibility : The products offered on our site comply with the French legislation in force. The customer is invited to find out about the laws in force in the country of delivery.
